Terms of Service

The agreement between Mondaysys Ltd. and your business when you use MondayPOS. Last updated: June 11, 2026.

1. The agreement

These Terms of Service ("Terms") are a contract between Mondaysys Ltd. ("MondayPOS", "we", "us") and the business that creates an account ("you"). By creating an account, starting a subscription or using the service, you accept these Terms on behalf of your business and confirm you have authority to do so.

2. The service

MondayPOS is a point-of-sale and retail management platform that includes billing, inventory, purchasing, accounting, CRM, HR and reporting features. The application is designed offline-first: tills continue working without an internet connection and synchronize when connectivity returns.

Parts of MondayPOS are built on the open-source Frappe and ERPNext projects, which are licensed under their own open-source licenses. Those licenses apply to the open-source components; these Terms apply to the hosted service, our proprietary additions and your account.

3. Accounts and responsibilities

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for the actions taken under your account and for managing staff roles and permissions.
  • Keep credentials confidential. Tell us immediately if you suspect unauthorized access.
  • You are responsible for the legality and accuracy of the data you record in MondayPOS, including prices, taxes and customer information.

4. Subscriptions and billing

  • MondayPOS is sold as a subscription priced per outlet, billed monthly or yearly in advance, in BDT unless agreed otherwise.
  • Yearly billing includes the discount shown on the pricing page at the time of purchase.
  • Additional outlets are charged at the add-on rate of your plan and are pro-rated for the remainder of the current billing period.
  • Subscriptions renew automatically at the end of each billing period unless cancelled before renewal.
  • We may change prices with at least 30 days' notice; changes apply from your next billing period.
  • Taxes such as VAT are added where applicable.

5. Free start

Where we offer a free tier or trial, it is intended for genuine evaluation by one business. We may set fair-use limits and may withdraw or modify free offerings with notice.

6. Acceptable use

You agree not to:

  • Use the service for unlawful purposes, including the sale of goods prohibited under Bangladesh law.
  • Attempt to breach, probe or overload our systems, or access another customer's data.
  • Resell, sublicense or white-label the hosted service without a written agreement with us.
  • Upload malicious code or use the service to send spam.
  • Copy or scrape the service to build a competing product.

7. Your data

You own the business data you record in MondayPOS. You grant us the limited rights needed to host, process, back up and display that data in order to run the service. Our Privacy Policy describes how we handle personal information.

You can export your data at any time. After cancellation, export remains available for 30 days.

8. Intellectual property

The MondayPOS name, logo, website content and proprietary software are owned by Mondaysys Ltd.. Except for the rights expressly granted in these Terms, no rights are transferred to you. Open-source components remain governed by their respective licenses.

9. Availability, support and changes

We work to keep the service available and performant, and the offline-first design keeps tills running during connectivity loss. We do not guarantee uninterrupted availability of the hosted service; maintenance windows and events outside our control can cause downtime.

Support is provided through the channels listed on our contact page. We may improve or change features over time; if a change materially reduces core functionality you pay for, you may cancel and request a pro-rated refund of the unused period.

10. Disclaimers

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. MondayPOS produces reports and VAT documents based on the data you enter; you remain responsible for reviewing filings and meeting your own legal and tax obligations.

11. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or loss of profits, revenue or data. Our total liability for claims arising out of the service in any 12-month period is limited to the amounts you paid us for the service in that period.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Suspension and termination

You may cancel at any time from your account or by contacting support; cancellation takes effect at the end of the current billing period. We may suspend or terminate the service for material breach of these Terms, non-payment after notice, or where required by law. On termination, data export remains available for 30 days as described above.

13. Governing law

These Terms are governed by the laws of Bangladesh. Disputes will be subject to the exclusive jurisdiction of the courts of Dhaka, after a good-faith attempt to resolve the matter directly with us.

14. Changes to these Terms

We may update these Terms from time to time. For material changes we will give at least 14 days' notice by email or in-app message. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
